I was in a car accident where the other car was at fault, was injured and was treating with a doctor; a month later, I was in another accident where the other car it at fault and now my neck injury is worse; can I make a claim in the second accident?

Here is today’s topic from the accident lawyer from Boca Raton (injury lawyer Miami, accident attorney Coconut Grove, injury attorney South Miami, accident lawyer Coral Gables, injury attorney Cutler Ridge, accident lawyer Perrine, injury lawyer Homestead, accident attorney Kendall).

Generally, to prove an injury case, you have to show liability, damages and causation. Here, the resulting injuries from both cases will be challenged on causation, as it likely will not be clear which accident caused which injury. It would be recommended to be honest with your doctors and the insurance companies about both accidents. Your doctors, in addition to treating you for the injuries, will also have to try to figure out which accident caused what, and that may not be so easy. If certain tests were done, like an MRI of the neck after the first accident but before the second accident, then those tests could be compared and any difference could obviously be attributed to the second accident, for example.

The general answer is that if you are having additional pain from the second accident, and if your doctors find injuries that they can related to both the first and second accident, then yes you could have a case for BOTH the first and second accident.

Of course, every case is unique and has to be judged based on the specific facts of the case. The advice in this blog is intended to be general in nature and should not to be construed as specific advice for a case, as a slight difference in the facts could ultimately change the result. Also, this blog is, as the web site suggests, based on Florida law and the laws of any other states or another country could vary significantly from Florida.
